Terms of Service

1. Acceptance of Terms

By creating an account or using EcomSwarm, you represent that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of a company or organization, you represent that you have authority to bind that entity.

2. Description of Service

EcomSwarm is a multi-agent AI platform for e-commerce workflows worldwide, including product and market research, ICP strategy, brand direction, landing-page and image generation, ad-creative production, hosted landing-page publishing, Shopify push, campaign blueprints, optimizer chat, and manual distribution hand-offs. The Service supports businesses using online payment, Cash on Delivery, or both.

3. Account Registration

You must provide accurate and complete information when registering. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at support@ecomswarm.com if you suspect unauthorized access.

4. Credits and Usage

The Service operates on a credit system. Credits are consumed when you initiate paid AI generation tasks, and the credit price of each action is shown before you confirm it. Credits are non-transferable. If a paid generation fails, the credits reserved for it are returned to your balance automatically.

5. Payment Terms

All published prices are stated in United States dollars (USD), regardless of any other currency shown for convenience. Automatic payments are not currently processed on the EcomSwarm website. Paid plans are arranged directly with us, normally through WhatsApp or email, and are activated manually on your account after we confirm the plan, payment method, amount, term, and any applicable taxes or fees with you.

Plans do not currently renew automatically through the website, and self-serve cancellation is not available. Contact us to renew, change, or end a paid-plan arrangement. Credits for an agreed plan period are added when we activate that period manually. We may change pricing, but any changed price applies only after it has been communicated to you and agreed for a future activation or renewal.

Card checkout is not live today. When card payments launch, they will be processed by Stripe, and Stripe's terms and privacy practices will apply to its processing of your payment information. We will not store full card numbers. Until then, no button on the Service completes an automatic card purchase.

6. Refund Policy

Due to the provider costs incurred for AI generation, we do not refund a generation once it has successfully run. Review the disclosed credit price before confirming an action. Failed paid operations return their reserved credits automatically, subject to the details in our Refund Policy.

7. Acceptable Use

You agree not to use the Service to:

• Generate content that violates applicable laws or advertising platform policies
• Produce deceptive, fraudulent, or misleading marketing materials
• Infringe the intellectual property rights of others
• Scrape or automate access to the Service beyond normal usage
• Resell or sublicense access to the Service without our written consent

8. Intellectual Property

You retain ownership of content you upload, including product images and descriptions. AI-generated outputs such as landing pages, copy, and brand assets are licensed to you under a non-exclusive, worldwide license for commercial use, subject to these Terms. The EcomSwarm platform, agents, and codebase remain our intellectual property.

9. Third-Party Services

The Service integrates with third-party services including Google, Anthropic, fal.ai, Apify, Firecrawl, Shopify, and Meta's public Ad Library for competitor research. Your use of outputs generated with these services may be subject to their respective terms. We are not responsible for third-party service outages or policy changes.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL ACHIEVE ANY SPECIFIC BUSINESS OUTCOME.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RCHID LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

12. Termination

We may suspend or terminate your account for violation of these Terms or as otherwise permitted by law. You may request account termination by contacting us at support@ecomswarm.com.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law and Jurisdiction

These Terms and any dispute arising out of or relating to them or to your use of the Service are governed by the laws of the State of Wyoming, United States of America, without regard to its conflict-of-law rules.

You and Rchid LLC agree that the state and federal courts located in Wyoming, United States of America have exclusive jurisdiction over any such dispute, and you consent to personal jurisdiction and venue in those courts. Nothing in this section limits mandatory consumer-protection rights you may have under the law of your country of residence.
